By accessing or using TimelyMeds ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Medical Disclaimer

IMPORTANT: TimelyMeds is a medication tracking tool, not a medical device or medical advice service.

Not Medical Advice

TimelyMeds does not:

• Provide medical advice, diagnosis, or treatment
• Replace consultation with healthcare professionals
• Verify medication interactions or contraindications
• Guarantee the accuracy of medication information
• Monitor your health or medical condition

Consult Your Healthcare Provider

Always consult with a qualified healthcare provider regarding:

• Starting, stopping, or changing medications
• Medication dosages and schedules
• Drug interactions and side effects
• Medical conditions and treatment plans

Emergency Situations

If you are experiencing a medical emergency, call emergency services immediately. Do not rely on TimelyMeds or any app for emergency medical assistance.

Use of the App

License

We grant you a limited, non-exclusive, non-transferable license to use TimelyMeds for personal, non-commercial purposes.

Acceptable Use

You agree to use TimelyMeds only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or viruses
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the App
• Use the App to harm others or yourself
• Reverse engineer or decompile the App

Account Responsibilities

If you create an account:

• You are responsible for maintaining account security
• You must provide accurate information
• You must be at least 13 years old
• You are responsible for all activity under your account
• You must notify us of unauthorized access

Data Accuracy and Responsibility

Your Responsibility

You are solely responsible for:

• The accuracy of medication information you enter
• Following your prescribed medication schedule
• Verifying information from external sources (barcode scanning, drug databases)
• Updating medication information when prescriptions change

No Guarantee of Accuracy

While we strive for accuracy, we do not guarantee that:

• Medication information from databases is complete or current
• Barcode scanning results are 100% accurate
• The App will be error-free or uninterrupted
• Reminders will always be delivered on time

Premium Features and Payments

Subscription Terms

Premium features are available through subscription:

• Subscriptions auto-renew unless canceled before renewal date
• Prices are subject to change with notice
• Cancellations take effect at the end of the current billing period
• Refunds are handled according to app store policies

Free Features Remain Free

Core medication tracking features will always remain free, as outlined in our About page. We will never revoke free features you've been using.

Intellectual Property

Our Rights

TimelyMeds and all related content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws.

Your Data

You retain ownership of the medication data you enter into TimelyMeds. We do not claim ownership of your personal data.

Feedback

If you provide feedback or suggestions, we may use them without compensation or obligation to you.

Third-Party Services

TimelyMeds may integrate with third-party services (app stores, cloud storage, drug databases). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services.

Disclaimers and Limitation of Liability

No Warranties

TimelyMeds is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability
• Uninterrupted or error-free operation

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or data
• Personal injury or property damage
• Missed medication doses
• Medical complications
• Loss of use or interruption of service

Our total liability shall not exceed the amount you paid us in the past 12 months, or $100, whichever is greater.

Indemnification

You agree to indemnify and hold harmless TimelyMeds and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another
• Your medication management decisions

Changes to the App

We reserve the right to:

• Modify or discontinue features (except core free features)
• Update the App for improvements or bug fixes
• Change pricing for premium features with notice
• Suspend or terminate service for maintenance or legal reasons

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting a notice in the App
• Sending an email if you have an account
• Updating the "Effective Date" at the top

Your continued use after changes constitutes acceptance of the updated Terms.

Termination

Your Right to Terminate

You may stop using TimelyMeds at any time. You may delete your account through the App settings.

Our Right to Terminate

We may suspend or terminate your access if:

• You violate these Terms
• Your account is inactive for an extended period
• We are required to do so by law
• Continued provision would be a security or legal risk

Effect of Termination

Upon termination:

• Your right to use the App ends immediately
• You should export your data before deletion
• Cloud-synced data will be deleted per our retention policy
• Provisions that should survive termination will remain in effect

Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the State of [Your State], without regard to conflict of law principles.

Arbitration

Our failure to enforce any provision does not constitute a waiver of that provision.

Assignment

You may not assign these Terms. We may assign our rights and obligations without restriction.
